OSH Golf Liability Waiver, Terms of Use & Facility Rules
29Seven T/A OSH Golf
By accessing, booking, entering, or using OSH Golf's unmanned 24/7 golf simulator facility, you acknowledge that you have read, understood, and agree to be bound by this Liability Waiver, Terms of Use, and Facility Rules.
This waiver applies to all users, including members, customers, guests, and visitors. Members and lead bookers are responsible for ensuring that all guests have read, understood, and agreed to these terms prior to using the facility.
By booking a session or entering the premises, you confirm your acceptance of this Liability Waiver.
1. Assumption of Risk
Golf activities involve inherent risks, including but not limited to injury from swinging clubs, errant shots, slips, trips, falls, misuse of equipment, and equipment malfunction.
Users voluntarily participate in activities at the facility at their own risk.
Users assume full responsibility for any personal injury, property damage, loss, or other harm arising from their use of the facility.
By using the facility, you voluntarily assume all known and unknown risks associated with participation in golf-related activities.
2. Release of Liability
You agree to release, waive, discharge, and hold harmless OSH Golf, 29Seven, its owners, employees, contractors, affiliates, agents, and representatives from any and all liability, claims, demands, actions, causes of action, damages, losses, costs, or expenses arising out of or related to:
Personal injury;
Property damage;
Loss of property;
Illness;
Death; or
Any other loss arising from the use of the facility.
This release applies to all members, guests, visitors, and customers using the facility.
3. Indemnification
You agree to indemnify, defend, and hold harmless OSH Golf, 29Seven, its owners, employees, contractors, affiliates, agents, and representatives from any claims, damages, liabilities, losses, costs, or legal fees arising from:
Your use of the facility;
Your breach of these Terms;
Any damage caused by you; or
The actions of any guest attending under your booking.
4. User & Guest Responsibility
Members and lead bookers are fully responsible for the conduct and actions of their guests.
Members and lead bookers must ensure all guests have read and agreed to this Liability Waiver prior to using the facility.
No person under the age of 16 may use the facility without supervision by a responsible adult.
Users must exercise caution and remain aware of their surroundings at all times.
Users and guests are responsible for any damage caused to the simulator, equipment, premises, fixtures, fittings, or property.
Users agree to reimburse OSH Golf for any repair, replacement, cleaning, or associated costs resulting from damage caused by misuse, negligence, or failure to follow these Terms and Rules.
5. Facility Rules & Regulations
General Facility Rules
Please ensure you have clean shoes and clean golf clubs before entering the hitting area.
During winter months, shoes worn outdoors are not permitted in the hitting area. Users must bring a clean and dry pair of indoor shoes.
Users should bring their own golf clubs and golf balls unless equipment hire has been arranged through OSH Golf.
Golf balls must be predominantly white and free from excessive markings, stickers, labels, felt-tip writing, or alterations that may damage simulator equipment.
No food or drink is permitted inside the simulator enclosure or near the simulator computer equipment at any time.
No alcohol, illegal substances, or persons under the influence of drugs are permitted on the premises.
Smoking and vaping are strictly prohibited anywhere within the facility.
A maximum of four (4) golfers are permitted per simulator bay at any one time.
Users must be respectful and considerate of other guests, neighbouring businesses, and surrounding properties.
Safety Rules
No children under the age of 16 may use the facility unless supervised by a responsible adult who remains present throughout the session.
Only one person may occupy the designated hitting area at any time.
All other persons must remain at a safe distance from the golfer.
Before swinging any club, users must ensure no person, object, or obstruction is within their swing radius.
Users must remain aware of their backswing and follow-through at all times.
All shots must be directed towards the impact screen only.
Practice swings and golf swings may only take place on the designated hitting mat area.
Golf clubs must not be swung anywhere outside the simulator hitting area.
Users are responsible for the safe use and handling of all equipment provided.
Damage & Incident Reporting
Users are financially responsible for any damage caused to the simulator, equipment, premises, fixtures, fittings, technology, screens, projectors, computers, furniture, or any other property resulting from misuse, negligence, reckless behaviour, or failure to follow these Rules and Regulations.
Any accident, injury, equipment fault, or damage must be reported as soon as reasonably possible to OSH Golf via dan@oshgolf.co.uk.
Booking Compliance
Users acknowledge that simulator sessions are limited to the time booked.
Where another booking follows immediately, OSH Golf reserves the right to terminate the session promptly at the end of the booked period.
Failure to comply with these Rules and Regulations may result in:
Immediate termination of the booking;
Removal from the premises;
Suspension or termination of future booking privileges or memberships; and/or
Forfeiture of any fees paid without refund.
6. Health & Fitness Declaration
You confirm that you are physically fit to participate in golf activities.
You acknowledge that you are responsible for determining whether participation is suitable for your physical condition.
You confirm that you do not have any medical condition that would make participation unsafe.
You accept full responsibility for your own health and wellbeing while using the facility.
7. Personal Property
OSH Golf accepts no responsibility for lost, stolen, or damaged personal property.
All personal belongings are brought onto the premises entirely at the owner's risk.
8. CCTV Monitoring & Photography
The facility is monitored by CCTV 24 hours a day for safety, security, crime prevention, incident investigation, and operational purposes.
By entering the premises, users consent to such recording in accordance with applicable data protection legislation.
Users acknowledge that photographs and/or video recordings may occasionally be taken and used by OSH Golf for promotional, marketing, website, advertising, or social media purposes without compensation.
9. Unmanned Facility
OSH Golf operates as an unmanned facility.
No staff members are routinely present to provide supervision, instruction, assistance, or first aid.
In the event of an emergency, users must immediately contact the emergency services by dialling 999 and seek appropriate assistance.
10. Use at Own Risk
All use of the facility is entirely at the user's own risk.
By entering and using the facility, users confirm that they have read, understood, and agreed to this Liability Waiver, Terms of Use, and Facility Rules.
OSH Golf reserves the right to refuse entry, terminate a booking, suspend membership privileges, or remove any user or guest who fails to comply with these Terms and Rules.
11. Acceptance of Terms
By booking a session, purchasing a membership, entering the facility, or using any equipment provided by OSH Golf, you confirm that:
You have read and understood this Liability Waiver, Terms of Use, and Facility Rules;
You voluntarily accept all associated risks;
You agree to be bound by these Terms;
You accept responsibility for your own actions and the actions of any guests attending under your booking; and
You acknowledge 29Seven T/A OSH Golf as the operating company of the facility
